As consultants providing expert witness testimony, Pearson is required to have a working knowledge of the legal process. In addition to the experience gained through the evaluation and presentation of our findings on over 300 projects, prior to founding Pearson Management Group, David Pearson was the Division Contracts Manager for Blount International, Ltd., Mercury Division, one of the largest contractors in the world during the early 1980s. Pearson has extensive knowledge of the contract formation process, the several common contract forms and governing case law regarding construction scheduling and damages. Pearson has conducted several seminars on the subject. In January 2000, Pearson prepared and presented graphics for a program entitled "Covering the Design Waterfront: Insuring Projects with Fragmented Design Responsibility" at the ABA’s winter forum in San Francisco. At the ABA’s Spring 2001 forum in New Orleans, Pearson presented a paper on the emerging use of project websites.

Acceleration and Delay Claims


Pearson has provided detailed oral and written analysis, deposition and trial testimony on over 300 acceleration and delay claims. Projects include virtually every type of construction, such as high-rise, heavy power, heavy industrial, water treatment, highways, high-tech bridges, forced air energy storage, tunnels, fast-track entertainment facilities and solar energy.

Professional Standard of Care Issues


Professional standard of care is sometimes an issue in construction disputes, particularly regarding the use of schedules for design and construction. Pearson has provided analysis and testimony in this area.

Preparation of Reports and Exhibits in Support of our Findings


In order to provide the best available format for our work product, Pearson maintains current software, utilizes state-of-the-art computerized graphics and printing equipment. In 1999, Pearson constructed a new 9,300sf office with state-of-the-art computing and communication capability.

Experience as an "Expert Witness" in Construction-Related Claims and Disputes


Pearson has testified as an expert witness in approximately seventy-five depositions and trials including Federal Court, State Court, and Arbitration. David Pearson has served on the American Arbitration Association’s panel of arbitrators for 14 years and served on the Texas Department of Criminal Justice’s Contract Disputes Review Board.
